Lindsay Lohan to miss mandatory court appearance after her passport is 'stolen' in Cannes

Lindsay Lohan will miss a mandatory court appearance today because she is stuck in France.

The actress claims her passport was stolen while she was at the Cannes Film Festival.

The 23-year-old is unlikely to make it back to Los Angeles in time for a crucial probation hearing on today that could result in jail time, her mother said.

Dina Lohan also denied media reports that the passport issue is an excuse for the Mean Girls star to skip court following reports that Lindsay has missed some alcohol education classes imposed for a 2007 drunken driving case.

Beverly Hills Superior Court judge Marsha Revel has ordered Lindsay, who flew to Cannes at the weekend for the annual film festival, to attend Thursday's hearing in person.

If she fails to appear, Revel is expected to issue a warrant for her arrest.

'I'm exhausted. I've been up for the last 24 hours with Lindsay and her attorneys dealing with this,' Dina was quoted as telling American website Radar Online.

'It is true that her passport was stolen. This was not a planned scheme. We are actively dealing with the French Embassy as we speak but unfortunately they close at a certain hour so we're trying to get someone in a higher echelon to help us.'

Dina said she was 'actively trying to get her home' but admitted that not attending the hearing would make her daughter's situation 'a little delicate.'

Lindsay had her probation extended last October. Judicial sources say that if she is deemed to have failed to complete her classes, Revel could decide to send her to jail at a later hearing.

Lindsay's estranged father Michael has said he believes the passport issue is 'just another lie' and told celebrity website TMZ.com that he plans to plead with the judge to order his daughter to a rehabilitation clinic.

The former Parent Trap child star was photographed hitting the party circuit in Cannes this week and has frequented Los Angeles and New York nightclubs for months.

But officials from the program she attends have said in court documents that Lohan 'has never come [to class] under the influence, been rude or disrespectful" and is "receptive to ideas regarding lifestyle changes'.

The classes are part of her sentence for a 2007 arrest for drunken driving, reckless driving and driving under the influence of cocaine.

She was also sentenced to 24 hours jail but spent just 84 minutes behind bars in 2007 because of overcrowding in Los Angeles lock-ups.

Lindsay went to Cannes amid rumors that she would play 1970s Deep Throat porn star Linda Lovelace in an upcoming biography film. But no official announcement has been made.
